So I am disappointed with the final ruling in the contest of the Washington State Gubernatorial election. But more than that I am quite disturbed.

The judge ruled that there were 1600+ illegal votes. About half of those votes are from identified individuals (felons, double voters, provisionals that shouldn’t have been counted). I can understand the reasoning behind the judge’s ruling that the Republicans failed to demonstrate by any standard how those votes should be deducted from the candidates, primarily because the Republicans put on a poor case.

It is the other half of the illegal votes that worries me. The judge ruled that the votes counted in excess of the known voters (credited, domestic violence, federal ballot) were illegal. Since these illegal votes aren’t tied to a person there is no way to determine the content of the ballot. And because of the pathetic record keeping in the counties with a large number of these illegal votes (particularly King County), there is no way to determine where these illegal ballots came from or who might be responsible. But for these illegal votes to impact the election contest the judge required that the Republicans demonstrate that the county employees specifically intented to benefit Gregoire. So even though King County failed to follow the law in the counting and accounting of ballots, everything is OK unless it is proven that they intented to benefit someone.

In the end the judge ordered that the 1600+ illegal votes be deducted from the total number of votes in the election, but didn’t apportion those votes to the candidates. Thus the total number of votes received by Gregoire and Rossi now exceeds the official number of votes. Whatever.

Lost

Lost was one of the TV shows with a lot of buzz last season, and ABC is rerunning the season this summer. Yesterday Snarkykat and I watched the first half of the pilot. It isn’t really fair to judge a series, but I was seriously unimpressed.
